Acceptance of Terms

By accessing or using Quests (“Service”), a service provided by Finalpoint, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

Quests offers two distinct components:

1. Desktop Application: An open-source application licensed under Apache 2.0 that runs locally on your computer.
2. Hosted Inference Service: A managed service providing AI inference capabilities through our API and third-party providers, which is subject to these Terms of Service.

We offer:

• Free desktop application (Apache 2.0 licensed)
• Optional managed AI inference services
• Subscription plans for enhanced features and credits
• Support for bring-your-own API keys

User Accounts

Account Creation

To access certain features, specifically the Hosted Inference Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent or abusive behavior.

Subscriptions and Payments

Billing

Subscription fees are billed in advance on a monthly or yearly basis. By subscribing, you authorize us to charge your payment method.

Credits

Subscription plans include monthly credits for AI inference:

• Credits reset at the beginning of each billing cycle
• Unused credits do not roll over
• Additional credits can be purchased or you can use your own API keys

Cancellation

You may cancel your subscription at any time through your account settings or Stripe customer portal. Cancellation takes effect at the end of the current billing period.

Refunds

Payments are non-refundable except as required by applicable law. Please contact us at support@quests.dev if you have specific inquiries regarding a charge.

Acceptable Use

You agree not to use Quests to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Distribute malware or harmful code
• Engage in fraudulent activities
• Abuse or overload our services
• Attempt to gain unauthorized access to our systems
• Use the service for any illegal or harmful purposes

Intellectual Property

Open Source License

The Quests Desktop Application is licensed under the Apache License 2.0. You are free to use, modify, and distribute the software in accordance with this license.

Your Content & AI Output

You retain all rights to the applications and content you create using Quests.

As between you and Finalpoint, LLC, you own all output generated by the AI models through our service (“AI Output”). Finalpoint, LLC hereby assigns to you all its right, title, and interest in and to such AI Output.

Our Content

Our branding, website content, and proprietary services (excluding AI Output) remain our intellectual property.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINALPOINT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Third-Party Services

Quests integrates with third-party AI providers (such as OpenRouter) and services. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is subject to their respective terms and policies.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or through the application. Continued use of Quests after changes constitutes acceptance of the new terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
